This Privacy Policy (“Policy”) is designed to help you understand how RustBooks (“RustBooks”, “we”, “us”) collect, use, process, disclose and share personal information (“Personal Data”), and your rights as a user when you use RustBooks application (“App”), our website located at https://rustbooks.store (“Website”), chatbot functionality (“Chatbot”) and any other related features, technologies or services (collectively the “Services”). By using the Services, you agree to the terms of our Terms of Use, including this, Policy.

1. Personal Information We Collect

RustBooks may collect Personal Data from our Website and App to secure, improve, and provide Services to our customers.  

1.1 Information You Provide

These are the information we collect only after it is provided by the user itself. 

  • Personal Identifiers: we may require Personal Identifiers which may include name, email address, profile photo/image, Instagram and Facebook profile links, contact numbers, profile description, account name and password, language preferences, or other similar identifiers to set up a RustBooks account (“Account”) or to provide Services.
  • Protected class information: This may include age/date of birth, gender (optional).
  • Communications: This may include support messages, feedback, survey responses, preferred genre, messages, questions and conversation history with the Chatbot. 
  • Preferences: This may include App settings, notification preferences, content , Profile customization

1.2 Automatically Collected Information

These are the information which we automatically collect as you use our Services.

Website 

  • Login Information: This may include browser type, IP address, user-agent string, time zone, type and model of a device, operating system, referral URLs, device information (such as device IDs), device settings, and mobile carrier name.
  • Usage Data: This may include pages viewed, time spent, features used, current reading status, last opened book and position, books completed, information regarding your interaction with our Website and advertisements.
  • Cookie Data: This may include essential, analytics and marketing cookies.
  • Customer Support Data: This may include full name, email address, phone number, or details about your questions or concerns when you request information about our Services. We collect this information when you communicate with us. 

App

  • Login Information: This may include IP address, user-agent string, time zone, type and model of a device, operating system, referral URLs, device information (such as device IDs), device settings, and mobile carrier name.
  • App Analytics: This may include screen views, feature usage, session patterns, user flows, operating system and its version, mobile carrier,
  • Performance Data: This may include App crashes, load times, memory usage, battery impact.
  • Device Identifiers: This may include IDFA (iOS), Google Advertising ID (Android), device fingerprints.
  • Location Data: This may include precise/ approximate location for content localization. 
  • Usage Data : This may include books viewed, time spent, features used, comments, messages, current reading status, last opened book and position, bookmarks, likes, books completed. 
  • Network Data: This may include Connectivity status, download patterns, sync behavior. 
  • Customer Support Data: This may include full name, email address, phone number, or details about your questions or concerns when you request information about our Services. We collect this information when you communicate with us. 
  • Chats and Community Activity: we may collect information related to your messages in public chat, private chat (DMs) and community chat, your reactions, likes, replies, if other users mention or tag you in the community chat or if you mention or tag them, your interaction with other users in the App which include friend requests you receive, your sent request, users who are friends of yours. 
  • Direct Messages: we may collect information related to contents of the messages, the recipients, date and times of messages for safety and security purposes. THE COLLECTION OF INFORMATION RELATING TO DIRECT MESSAGES SHALL NOT BE ENCRYPTED WHICH MEANS DATA IS STORED AND TRANSMITTED IN READABLE FORM AND IT MAY BE ACCESSED BY AUTHORIZED ADMINS ANYTIME FOR MODERATION.
  • Data for Research & Analysis: we may collect information such as your interests, genre, list of often read books, usage patterns to better understand our business, analyze our operations, maintain, improve, innovate, plan, design, and develop the Services and our new products

1.3 Information collected from third- party services

These are the information we collect from the third-party only if it used by the user.

  • Account Data: we get personal account data which include email, name, profile image from the third-party information providers like Apple, Google, Facebook only when you decide to log in using these social networking platforms. For more information regarding how these platforms collect data and may share with third-parties, please refer to their respective Privacy Policy.

2. For what purpose we process your Personal Data

we use your Personal Data for a variety of business purposes, which include providing our Services, market our products and Services and others as described below:

  • To provide our Services to you: which includes enabling you to use the Services in a seamless manner and preventing or addressing Services errors or technical issues;
  • Managing your information and accounts: we may process your Personal Data to secure your accessing personal account and send you technical notifications or mails about the performance of our Services, security, payment transactions, notices regarding our Terms and Conditions of Use or this Policy;
  • To provide or answering your customer or technical support;
  • To personalize our ads and send you marketing communications;
  • To communicate with you regarding your use of our Services: These may include reminders, push notifications, emails;
  • To process your payments and refunds;
  • To provide automated Chatbot responses;
  • Save your current reading position for seamless continuation;
  • Power public profiles and community interaction;
  • Enable chat features (public, private, and community);
  • Improving, upgrading, or enhancing our Services;
  • To ensure the safety and security of the Services;
  • To enforce our agreements and contractual commitments;
  • Developing new products and Services and

3. With whom we share your Personal Data

we share your Personal Data with third parties that help us operate, provide, improve, integrate, customize, support, and market our Services. The categories of third parties we share information with include: 

3.1 Service Providers

we may share your Personal Data with our third-party service providers who use that information to help us provide our Services or perform business functions on our behalf, based on our instructions. This may include service provider that provide us with cloud storage, marketing, data analytics, data security, AI assistance to our Chatbot and customer service.

3.2 Law enforcement agencies and other public authorities

we may share your Personal Data to enforce our Terms and Conditions of Use, to protect our rights, privacy, safety, or property, and/ or that of our affiliates, you or others, and to respond to requests from or to comply with law enforcement agencies, regulatory agencies, courts and other public and governmental authorities, or in other cases provided for by law. 

3.3 Advertising Partners

we may share your Personal Data with third-party advertising partners. These third-party advertising partners may set technologies and other tracking tools on our Services to collect information regarding your activities and your device including your IP address, cookie identifiers, page visits, location etc. These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. 

 

4. Data Retention

we retain the categories of collected Personal Data for the period necessary to provide our Services and to comply with legal obligations, resolve ongoing disputes or to protect our legal rights. Personal Data shall be deleted by us after the user withdraw its consent, provided that we are not legally required or otherwise permitted to hold such data. 

The retention period of collected Personal Data is based on following criteria including:

  • need to operate the business and to enforce our agreements, conduct audits;
  • type of personal information collected; and

to comply with legal, contractual or similar obligation to retain the personal information (e.g., mandatory data retention laws, government orders to preserve data relevant to an investigation, or data that must be retained for the purposes of litigation or disputes).

5. International Data Transfers

5.1 Our data processing activities may involve the transfer of Personal Data with including service providers, advertising partners and other recipients located outside of the European Economic Area or the UK, which may not provide the same level of data protection for your Personal Data. Such a transfer is permissible if the European Commission or the UK government (as applicable) has determined that an adequate level of data protection is provided in the relevant country. 

5.2 If such an adequacy decision of the European Commission or the UK government (as applicable) does not exist, a transfer of your Personal Data to such countries will only take place if appropriate safeguards exist i.e., by using the EU Standard Contract Clauses or the Standard Data Protection Clauses as approved by UK’s supervisory authority  (Art. 46 of GDPR), or if one of the conditions listed in Art. 49(1) of GDPR is met. 

5.3 In exceptional circumstances, if there is no adequacy decision for the country in which the Personal Data is being transferred or other appropriate safeguard in place, we may rely on your explicit consent under Article 49(1)(a) and Article 49(1)(b) of GDPR for such transfers. 

 

6. Our use of Cookies and Analytics

we may use cookies, pixel tags, web beacons and other similar technologies (“Tracking technologies”) to automatically collect information through our Services. Tracking technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that record certain pieces of information when you visit our Services. we may use these tracking technologies to help identify irregular behavior, prevent fraudulent activity and improve security, as well as making it possible for you to save your preferences and help us understand how you interact with our Services.

You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features. We recommend you keep cookies activated.

 

7. Your Privacy Rights

In accordance with applicable law, you may have the following right to:

  • Accessing/ reviewing/ updating / correcting your personal data: You may review, edit, or change the personal data where it is inaccurate or incomplete. 
  • Deleting your Personal Data: You can request erasure of your Personal Data, provided we are not legally required or otherwise permitted to hold such data or to comply with any legal obligation. When you delete your account, we erase your profile data however, past public/community chats may remain to preserve conversation history.
  • Objecting to or restricting the use of your personal data:  You can ask us to stop using all or some of your Personal Data or limit our use thereof.
  • The right to data portability: If you wish to receive your Personal Data in a machine-readable format, you can send respective request to us at support@rustbooks.app
  • Right to withdraw your consent: The user has the right to withdraw consent at any time if you have given us separate consent to data processing activities; such a withdrawal does not affect the legality of the processing that was carried out on the basis of consent until withdrawal;
  • Right to opt-out: You have the right to opt-out from certain types of processing (e.g., targeted advertising, the sale of Personal Data, limiting the use and disclosure of sensitive information, and profiling, as defined by the applicable data protection laws).

8. Children’s Privacy

RustBooks’ Services are not directed to children under 13 (or other age as required by local law). we do not knowingly Personal Data from children. If we become aware that a child has provided us with Personal Data, we will delete such Personal Data we have collected and remove the account, unless we have a legal obligation to keep it. If you are a parent or guardian and believe your child has uploaded Personal Data to our Website without your consent, you may contact us as described in “Contact Us” below.

 

9. Changes to This Policy

we may review and revise this Policy from time to time in our sole discretion. The material changes shall be notified through our App or via email. By continuing to access or use of the Services shall imply your agreement to the updated Policy.
